…and I am so moved and touched. I currently write a book on confidence and one of the key premises of being confident is choosing the positive perspective. My heart was filled with respect and admiration for your positivity, huge inner power AND sincerity. I agree that at the time ‘disaster’ strikes (we don’t call it that after, but it feels like it at first) it is hard to be cheerful and find the flip side. Yet our attitude towards life then takes over – and we make the choice. As you have done – ‘you ain’t dead yet, let’s to the best of the time I’ve got. Sky diving, inspiring others, write another book, spend time with my loved ones…Seeing your video is one of my Christmas discoveries / gifts. I will be showing your clips in my confidence workshops….so your legacy and inspiration is spread over in Singapore and other parts of the world. I want to thank you for blessing me with the gift of your book this past Sunday. I have nearly finished it already. Once I started reading I simply could not put it down. You may not know that I had serious open heart surgery in 2007. Our family had joined St. Francis of Assisi and I had already been coaching football at St. X for a few years by then. I just want you to know that I have found your book to be a personal inspiration and as usual; the fact that you shared it with me represents another intervention by the Holy Spirit in my life. The message that I am getting from the Holy Spirit and you is, “You ain’t dead yet!”.

I have tell you that I smiled when I read about the importance “Intensity” plays in one’s decision to succeed. I probably had that ear to ear grin like the Grinch when he discovered love. I smiled because you used Celtic Football coaching as an example of intense desire to succeed. You may not know that I actually talked Mark and Mike Meiners into having our coaching retreats. I planned and organized them to first be held at my Father-in-law’s condo at Lake Cumberland. I think they initially saw it as a water skiing / bonding trip but were pleasantly surprised when I brought dry erase boards and books and videos on various offense and defense strategies. The meetings were so successful, so much fun, and such a “team” building experience that they continued even after I left. I love the fact that I shared that experience with you and all the men I coached with at St. Patrick. I cannot argue if someone were to say that our passion for the team and the growth of the kids actually represented an obsessive compulsive disorder at times. :-) Nevertheless; there is no doubt that we all brought intensity and “will” to our efforts and I truly believe that the boys learned multiple life lessons as a result of your influence and all of our coaches at the time. Thank you for sharing our experiences with your readers as an example of intense desire and focused effort to be successful.

Faculty Favorite Awards

John Baumann – Accountancy – College of Business – An amazing teacher who truly teaches what the students need to know outside of class. He is very inspiring and someone who deserves this award.

Each year, the Delphi Center for Teaching and Learning asks UofL students to nominate faculty, staff, and graduate teaching assistants who make a significant difference in their learning and intellectual growth. Nominees exemplify the true spirit of teaching and learning through the eyes of their students. Using an online nomination process that is open to all students at the end of fall and spring semesters, students submit nominations and comments about their favorite teachers.

Recognition
All faculty, staff, and graduate teaching assistants who receive nominations receive a formal letter of recognition from the Provost, along with a certificate, and are invited to attend the Faculty Favorite Reception, to be held on November 7, 2011, at the University Club.

All students who submitted a nomination are also invited to attend the reception to celebrate and honor their faculty favorite. Individual student nominations are also posted on the Faculty Favorite Awards website.

Additionally, faculty, staff, and graduate teaching assistants who receive the most nominations are formally recognized in a video presentation that premieres at the Delphi Center’s annual Celebration of Teaching and Learning. The video features the “top” nominees (instructors are eligible every four years) and a selection of students who submitted a nomination on their behalf. This year’s Celebration will be held on Friday, February 10, 2012 at Shelby Campus.

Good Morning John,

Just wanted to reply to this very touching note you sent at the beginning of the month. It is ironic because I passed this exact story on our 20 years ago when teaching business managers and executives for the companies I worked for. One of the areas that I worked in just happens to be there in your part of the country. But over the years I had stopped telling it and let it slip from my mind until I received your email. So thank you very much for passing it along and keeping the spirit alive. I also want to congratulate you on the the two books and I will be looking forward to reading them when they hit the shelves.

WHAT GOES AROUND COMES AROUND

One day a man saw a old lady, stranded on the side of the road, but even in the dim light of day, he could see she needed help.. So he pulled up in front of her Mercedes and got out. His Pinto was still sputtering when he approached her.

Even with the smile on his face, she was worried. No one had stopped to help for the last hour or so. Was he going to hurt her? He didn’t look safe; he looked poor and hungry.

He could see that she was frightened, standing out there in the cold. He knew how she felt. It was that chill which only fear can put in you.

He said, ‘I’m here to help you, ma’am. Why don’t you wait in the car where it’s warm? By the way, my name is Bryan Anderson.’

Well, all she had was a flat tire, but for an old lady, that was bad enough. Bryan crawled under the car looking for a place to put the jack, skinning his knuckles a time or two. Soon he was able to change the tire.. But he had to get dirty and his hands hurt.

As he was tightening up the lug nuts, she rolled down the window a and began to talk to him. She told him that she was from St. Louis and was only just passing through. She couldn’t thank him enough for coming to her aid.

Bryan just smiled as he closed her trunk. The lady asked how much she owed him. Any amount would have been all right with her She already imagined all the awful things that could have happened had he not stopped.

Bryan never thought twice about being paid.

This was not a job to him.. This was helping someone in need, and God knows there were plenty, who had given him a hand in the past. He had lived his whole life that way, and it never occurred to him to act any other way.

He told her that if she really wanted to pay him back, the next time she saw someone who needed help, she could give that person the assistance they needed, and Bryan added, ‘And think of me..’

He waited until she started her car and drove off. It had been a cold and depressing day, but he felt good as he headed for home, disappearing into the twilight.

A few miles down the road the lady saw a small cafe. She went in to grab a bite to eat, and take the chill off before she made the last leg of her trip h home. It was a dingy looking restaurant. Outside were two old gas pumps. The whole scene was unfamiliar to her. The waitress came over and brought a clean towel to wipe her wet hair. She had a sweet smile, one that even being on her feet for the whole day couldn’t erase. The lady noticed the waitress was nearly eight months pregnant, but she never let the strain and aches change her attitude. The old lady wondered how someone who had so little could be so giving to a stranger. Then she remembered Bryan ..

After the lady finished her meal, she paid with a hundred dollar bill. The waitress quickly went to get change for her hundred dollar bill, but the old lady had slipped right out the door.. She was gone by the time the waitress came back. The waitress wondered where the lady could be. Then she noticed something written on the napkin.

There were tears in her eyes when she read what the lady wrote: ‘You don’t owe me anything.. I have been there too. Somebody once helped me out, the way I’m helping you. If you really want to pay me back, here is what you do: Do not let this chain of love end with you.’

Under the napkin were four more $100 bills.

Well, there were tables to clear, sugar bowls to fill, and people to serve, but the waitress made it through another day. That night when she got home from work and climbed into bed, she was thinking about the note.

Money and what the lady had written. How could the lady have known how much she and her husband needed it? With the baby due next month, it was going to be hard……

She knew how worried her husband was, and as he lay sleeping next to her, she gave him a soft kiss and whispered soft and low, ‘Every thing’s going to be all right. I love you, Bryan Anderson.’

EEOC Announces Highest Number of Discrimination Charges in Agency’s 45-Year History

Employers Embrace Enhanced Compliance & Prevention Efforts to Manage Escalating Risk in the Face of Expanded EEOC Enforcement Efforts

Just released Equal Employment Opportunity Commission (EEOC) charge statisticsfor FY 2010 set yet another record – both in number of charges, and total dollars recovered from employers. On the heels of two consecutive years of record high charges in 2008 and 2009, the 2010 statistics demonstrate a resilient and powerful trend of increased exposure to costly discrimination claims.

The total number of charges filed in FY 2010 rose to a record 99,022, up 7.1% from FY 2009. While the agency has not yet released the charge details by protected category, employers can expect to see retaliation, race, religious and disability discrimination top the list as they did in 2009.

The rise in EEOC charges is not surprising. The ADA Amendment Act, the Genetic Information Nondiscrimination Act, and the Lilly Ledbetter Fair Pay Act have expanded the EEOC’s statutory authorities, making it easier to file a discrimination claim.

Continued high unemployment is also a major factor in these numbers. Significant layoffs and terminations, coupled with a scarcity of alternative employment, has drastically expanded the pool of potential claimants and litigants. Given our “jobless recovery” employers can expect to see the trend of rising discrimination claims continue into 2011.

Along with the number of charges filed, the EEOC is boasting a record $319 million recovered from employers -the highest level in the Commission’s history. The agency is crediting the increase to easier filing procedures and extensive training for their employees – both part of a bigger systematic initiative to more efficiently and effectively enforce discrimination laws. The EEOC’s increased efforts are clearly working. Despite the surge in charges, the agency was able to keep its backlog relatively constant from 2009-2010.

The shift in control of the House of Representatives will also drive even greater enforcement activities in the coming year. Though Republicans now control the House, the Obama Administration does not need Congressional approval to work through federal agencies (like the EEOC) to enforce existing laws. So in 2011, the Administration will undoubtedly place even greater emphasis on enforcement.

The EEOC is better equipped than ever to investigate the record number of claims being filed – and employers need to be prepared. Now’s the time for organizations to enhance their comprehensive anti-discrimination policies to cover all forms of discrimination.

But remember, employees rarely read policies and policies alone do not effectively guide and change behavior. U.S. Supreme Court and EEOC guidelines require companies to provide the entire workforce with effective and periodic training. Being able to prove that such preventative education programs are in place can help employers to establish a robust and valuable litigation shield that can help to eliminate claims, and to significantly reduce damage awards.

With both strong policies and effective anti-discrimination training, employers will be well equipped to avoid the rising tide of EEO claims. But if the EEOC comes knocking on your door, effective training can help to assert powerful affirmative defenses that can save your organization millions.
